The four requirements of Regulation (EC) 1071/2009 to work as a road haulier and the capital that financial standing requires every year.
Machine translation, not verified [NV].
Financial standing is one of the four requirements set by Regulation (EC) 1071/2009 for engaging in the occupation of road haulier in the European Union [V].
The four requirements
Under Article 3, paragraph 1, the undertaking must [V]:
- have an effective and stable establishment;
- be of good repute;
- have appropriate financial standing;
- have the required professional competence.
All four are required together: without one of them, capital is not enough.
Good repute
The conditions for good repute are set by the Member States (Art. 6, para. 1) [V]. Serious infringements can lead to its loss, unless the authority considers the loss disproportionate; in that case, the reasons are recorded in the national register [V].
Financial standing: the figures
Article 7, paragraph 1, sets the capital and reserves the undertaking must prove every year [V]:
- 9.000 € for the first vehicle;
- 5.000 € for each additional vehicle over 3,5 tonnes;
- 900 € for each additional vehicle between 2,5 and 3,5 tonnes.
For undertakings that only use vehicles between 2,5 and 3,5 tonnes [V]:
- 1.800 € for the first vehicle;
- 900 € for each additional vehicle.
Member States may also require the amounts of the first list for those vehicles (Art. 7, para. 1, last subparagraph) [V]. The competent authority may agree or require that financial standing be proven by a bank guarantee or insurance (Art. 7, para. 2) [V].
Why it matters
For anyone thinking of setting up their own transport company, these figures are a starting point. And financial standing is not proven once only: Article 7 refers to every year.
